Terms of Service

1. Agreement

TrackYaTradie is provided by Bailey Holdsworth trading as TrackYaTradie (ABN 29 813 854 114) ("we", "us", "our"). These Terms govern your use of the TrackYaTradie web, iOS and Android apps and website (the "Service"). By creating an account or using the Service you agree to these Terms and to the Privacy Policy, which forms part of them. If you use the Service on behalf of a business, you agree on that business's behalf and confirm you have authority to do so.

2. The Service

TrackYaTradie is a job, profit and team management tool for trade businesses: project and cost tracking, timesheets, scheduling, quoting, invoicing, client management and accounting integrations. We improve the Service continuously and may add, change or remove features over time.

3. Accounts and eligibility

  • You must be at least 18 years old to create an account.
  • Keep your login details secure - you are responsible for activity under your account.
  • Company owners are responsible for the team members they invite, for the accuracy of the information they add about them, and for removing access when someone leaves.
  • Give us accurate account information and keep it up to date.

4. Free trial

New companies get a 14-day free trial with up to 3 tradies, no card required. When the trial ends, you need to choose a plan to keep using the Service - nothing is deleted, and your data is kept for you. We may change trial terms for future signups, but not for a trial already underway.

5. Subscriptions and billing

  • Paid plans are billed in advance, monthly or annually, through Stripe.
  • Subscriptions renew automatically until cancelled.
  • You can cancel anytime from your billing page. Cancellation takes effect at the end of the period you have paid for.
  • Prices are in Australian dollars and include GST where applicable.
  • Each plan includes a set number of tradie seats; you can change plans as your crew changes.

6. Price changes and grandfathering

Existing subscribers stay on the pricing ladder they signed up on, including when changing between plans on that ladder. If we ever need to increase the price of a plan you are already on, we will give you at least 30 days' notice by email, and the change will apply only from your next renewal after that notice.

7. Refunds

Refunds are handled under our Refund Policy, which includes a 30-day money-back guarantee on your first payment and is incorporated into these Terms. Nothing in these Terms or that policy limits your rights under the Australian Consumer Law.

8. Referral program

  • When a business you refer becomes a paying customer, you may receive a $50 AUD credit toward your subscription, up to a maximum of 3 credits in total.
  • Credits are applied automatically to your billing balance while you hold a paid subscription, and offset future subscription charges; they have no cash value. Once applied, a credit is not removed if the referred business later cancels.
  • If a credit you have earned does not come through automatically - for example, if you were still on your free trial when your referral converted - email support@trackyatradie.com and we will apply it.
  • Self-referrals, fake accounts and other abuse void the credits involved.
  • We may change or close the program for future referrals at any time; credits already earned are honoured.

9. Online invoice payments (Stripe Connect)

Where we make online invoice payments available and you choose to enable them, your clients can pay your invoices online by card or BECS bank debit. If you enable this feature:

  • Payments are processed by Stripe through your own connected Stripe account, under the Stripe Connected Account Agreement, which you accept during setup. Funds flow to you, not to us - we never hold your money.
  • You are the merchant of record for payments from your clients. You are responsible for the work you invoice, the accuracy of your invoices, any refunds owed to your clients, and any disputes or chargebacks.
  • Your client pays the exact invoice total. You bear Stripe's processing fees and our platform fee, per the fee schedule shown in Settings when you enable the feature (currently 0.5% with a $0.50 minimum, capped at $10 for BECS payments).
  • We are not a party to the contract between you and your client, and we are not a bank, payment processor or financial adviser.

10. Your clients' data

When you add client details, send quotes or invoices, or take online payments, you warrant that you are entitled to give us that information and that you handle your clients' personal information lawfully. We process it on your behalf as described in the Privacy Policy. You are responsible for claims arising from client information you upload in breach of this section.

11. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, or upload unlawful, offensive or infringing content
  • Send spam or messages that breach the Spam Act 2003 (Cth) through the Service
  • Attempt to access other companies' data or probe, scan or test the security of the Service
  • Resell, copy, scrape or reverse-engineer the Service
  • Interfere with the Service's operation or place unreasonable load on it
  • Share your account or impersonate another person or business

We may suspend or terminate accounts that breach this section (section 17).

12. Your data and our IP

  • Your data is yours. You own the business data you put into the Service. You grant us a licence to host, process, transmit and display it as needed to operate the Service.
  • The Service is ours. The software, design and branding are our intellectual property. These Terms give you a right to use the Service, not to copy it.

13. Third-party services and integrations

The Service integrates with third-party services such as Xero and Stripe. Those services have their own terms, and we are not responsible for their availability, changes or errors. Figures synced to your accounting software are provided as-is - always verify them with your accountant. Nothing in the Service (including profit and job-costing figures) is financial, tax or legal advice.

14. Availability, backups and data on exit

  • We aim for high availability but do not guarantee the Service will be uninterrupted or error-free.
  • We run automated backups, but you should also keep your own records of critical business information.
  • If your subscription ends or your account is terminated, you have at least 30 days to export your data. In practice we retain it longer (see the Privacy Policy) unless you ask us to delete it.

15. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees or any other right or remedy you have under law that cannot be excluded. To the extent permitted by section 64A of the Australian Consumer Law, our liability for a failure to comply with a consumer guarantee (other than a major failure) is limited, at our option, to resupplying the services or paying the cost of having them resupplied.

16. Disclaimer and limitation of liability

Subject always to section 15:

  • The Service is provided "as is" and "as available", without warranties beyond those that cannot be excluded by law.
  • We are not liable for indirect or consequential loss, loss of profits, revenue or data, or for business decisions made in reliance on figures in the Service.
  • Our total liability arising out of or in connection with the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

17. Suspension and termination

  • You can stop using the Service and cancel your subscription at any time.
  • We may suspend or terminate your account for a serious or repeated breach of these Terms, giving you notice and a chance to fix the problem where it is reasonable to do so.
  • Sections that by their nature should survive termination (including 10, 12, 15, 16 and 19) survive it.

18. Changes to these Terms

We may update these Terms as the Service evolves. The date at the top shows the latest version. For significant changes we will give notice on the website or by email, and your continued use of the Service after the change takes effect is acceptance of the updated Terms.

19. Governing law

These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
